I Got Terminated After Taking Medical Leave

I notified the HR Director and my supervisor at the end of November 2007 that I would be having hip replacement surgery on December 14, 2007, which would require me to be off work for a total of 12 weeks.

The HR Director advised me that I would need to use my floating holiday, vacation, and sick leave before Family Medical Leave would take affect. The HR Director also assured me that my job would be protected and it would be available when I returned to work after my surgery. My Family Medical Leave expired on March 4, 2008.

On March 3, 2008, the HR Director called me to tell me that they were taking me off Family Medical Leave and placing me on Administrative Leave with pay for three days until my supervisor returned to work. I was to return to work on March 6, 2008.

When I returned to work on March 6th, I was told that I was being let go supposedly because of concerns of performance. I had never received any written warnings or any other written documentation stating that my job performance was not up to par. This company has a constant turnover in employees-averages five employees per month (out of a total of 65 employees) who either are terminated or quit.

    I worked for a non-profit that had on average 60-70% annual turnover. The only survivors were the executive level who were bringing in over six figures a year. The rest of the pions were used, abused, and kicked to the curb fairly quickly. I was one of those pions. I worked my ass off – doing my job and picking up the slack for numerous execs who slipped out the door early. I can’t tell you how many 5:00pm’s would roll around and I would have a project thrown on my desk by an exec, with a post-it stating, “you’re the best – thanks.” I was the definition of a team player. Less than a year later, the HR manager told me they were “downsizing” and would be giving my job to another pion who I knew was making half my salary. I found out after I left from other pions that I was let go because I was a threat – I always appeared to be too eager and too hard working. So in essence, I was laid off for being too productive.

    I was let go while on FMLA I had an ankle surgery in the beginning of december of 2008 was scheduled to come back March 4th was called on January 10 told we are letting you go because we cannot afford you any longer. I was told before I left for surgery leave that my job is safe and I didnt have anything to worry about but getting better! I will never eat or do any business with this company again.
