I Got Terminated After Taking Medical Leave

I notified the HR Director and my supervisor at the end of November 2007 that I would be having hip replacement surgery on December 14, 2007, which would require me to be off work for a total of 12 weeks.

The HR Director advised me that I would need to use my floating holiday, vacation, and sick leave before Family Medical Leave would take affect. The HR Director also assured me that my job would be protected and it would be available when I returned to work after my surgery. My Family Medical Leave expired on March 4, 2008.

On March 3, 2008, the HR Director called me to tell me that they were taking me off Family Medical Leave and placing me on Administrative Leave with pay for three days until my supervisor returned to work. I was to return to work on March 6, 2008.

When I returned to work on March 6th, I was told that I was being let go supposedly because of concerns of performance. I had never received any written warnings or any other written documentation stating that my job performance was not up to par. This company has a constant turnover in employees-averages five employees per month (out of a total of 65 employees) who either are terminated or quit.

    I worked for a non-profit that had on average 60-70% annual turnover. The only survivors were the executive level who were bringing in over six figures a year. The rest of the pions were used, abused, and kicked to the curb fairly quickly. I was one of those pions. I worked my ass off – doing my job and picking up the slack for numerous execs who slipped out the door early. I can’t tell you how many 5:00pm’s would roll around and I would have a project thrown on my desk by an exec, with a post-it stating, “you’re the best – thanks.” I was the definition of a team player. Less than a year later, the HR manager told me they were “downsizing” and would be giving my job to another pion who I knew was making half my salary. I found out after I left from other pions that I was let go because I was a threat – I always appeared to be too eager and too hard working. So in essence, I was laid off for being too productive.

    I was let go while on FMLA I had an ankle surgery in the beginning of december of 2008 was scheduled to come back March 4th was called on January 10 told we are letting you go because we cannot afford you any longer. I was told before I left for surgery leave that my job is safe and I didnt have anything to worry about but getting better! I will never eat or do any business with this company again.

    Wow! I am shocked. I guess this happens more than I ever imagined. Maybe it is a good thing that I am no longer employed anywhere at this time. I now stay at home and take care of my 90 year old mother-in-law. To tell you the truth, I don’t think that I will look for employment in the future if or when the opportunity arises. In today’s world it is just not worth all the BS that people have to put up with. If I do want extra income I will check into employment from home.

    I see this must be a more common problem than expected!! I was on medical leave from my job of almost 15 years and drawing short term disability. I had been out of work for almost 5 months and finally released to go back to work. I contacted my office manager to inform her I would be coming back to work the next week. Two days later I received a certified letter in the mail from my office manager on behalf of the company informing me that I was “over qualified” and “there are currently no positions available” for someone with my experience. I was shocked, stunned, speechless, etc. I was the ONLY person in the whole company who did my job. I was the medical coder for a group of six physicians. The other people in my department did the other billing, I was the ONLY one who knew how and did ALL the coding (inpatient as well as all the outpatient) So, how was I over qualified?!?!?!
    It’s been a little over three years since that happened, and I’m still stunned!!

    I always worked in a corporate setting but after getting laid off
    I took a job in a 2 Dr Pain Mgmt office. In the 9 months I saw 9 employees leave! I heard the Doctors screaming in the office in front of not only co workers but also patients ! It bothered me and then it was my turn! He screamed that I didn’t have a brain and threatened me at least 3 days a week with termination. After belittling me I walked away with tears in my eyes and was later written up for being unprofessional and making the Dr look bad!! Not two wks later there was talk that they were trying to rehire someone’ that had quit in Sept! I was later written up for a 90 day notice because the sales rep forgot lunch. I gave them them the reason and was told no to make excuses. I gave the office mgr a ltr from the doctor stating I was having surgery on the 3rd of Jan and she mentioned I would be out for weeks. The date the ltr was dated Dec 12th! I told one of the other girl that before she marked a certain person as a $25 no show I felt anything could have happened because she scheduled it 3 months in advanced! I called and there was answer I just told the other girl to leave it as clxd and if we found out she didn’t call or show then charge her! They wrote me up forcFORCING her to falsifying documentation! They terminated me 1 week before Xmas and two before Major surgery Terminated Dec 17 other female that quit in Sept started Dec 20th! Emotionally a wreck and mentally sick days before major surgery
    It was all calculated and planned because the office mgr offered herself as a reference! I am in the process of hiring a lawyer

    I went off on a temporary medical leave and after 1 month returned to work. 4 hours into my shift the boss came and told me he was letting me go. Nice. I guess 7 years of hard work pays off
