Job or Slavery

My last job they kept cutting all of our pay in half and then making the salary people work more and more on 40 hrs of pay. I’d work 235 hrs in 2 weeks and get paid for 40 and half pay! I added up the hours i did in 1 month I did over 3 months of work in 1 and was only paid for 1. And I’m not exaggerating, they actually brought cots in for a project so everyone had to pull all nighters! A lot of my department would sleep at their desks cuz they’d be to tired to drive home. I’m talking 8 am- to 3 am shifts each day. If you left before midnight you were scoured at.

The company had a policy of “team spirit” so we had to act positive and smiley all the time or you’d loose your job. It made things way more stressful having to put on a fake show from 8 am to 3 am shifts. AGAIN 40 hours pay!

Well they laid me off the fist time with no notice and I’d been there for close to 4 1/2 months. Then after their slow season they brought me back, turned out it was so they didn’t have to pay the original temp agency that had landed me the job. So they made scammed the people you help me get a job… then they started with the pay cuts as I mentioned earlier.

Then they wanted to cut me even lower then half of what I was making before and keep me as salary. which on salary you have to do their mandated extra hours and legally you can’t look for a second job!

I felt like a slave they took advantage of me again and again. I looked into it and at the pay they wanted to give me and the direction of the company, I’d make more on unemployment then I would on my pay checks and if I stayed in 6 months if they laid me off then, I’d be making even lower on my unemployment because of my mass pay decreases. So I convinced my department manager to help me out and just lay me off.
Which he was able to do…

So I’ve been searching for a new job but reaching the end of my 6 months of Unemployment… so I need to extend it. My problem is my old job called 2 weeks ago and is trying to hire me back at that lower wage and on salary again! I can’t work like that! If they brought me back at my original pay I would… But I know they wont and if they did in three months they’d give me a pay cut again and make me work these insane hours.

Here’s my questions… On salary can they legally make you work over 80 hrs a week on 40 hrs pay year round?

And on unemployment do I have to take my old job back if it’s at lower pay from what they originally hired me??? They’d take me back at the pay I technically ended at… but that was un-livable after so many pay cuts! I could not survive on that! I’d loose my house while working 80 hr weeks! and would have no time to find a real job and would not be allowed to find a 2nd job. Can they cancel my unemployment as a “refuse a job position” type situation? That’s what I’m scared of.

    Call the labor department in your state. There are law regarding overtime etc.

    You don’t need to accept the job offer, due to the lower salary, but you do need to tell your Unemployment office that you received the job offer and turned it down (and why). From what you’re saying it will probably be deemed an acceptable reason to turn down the job.

    BUT — you’ll be in a pickle in terms of dealing with the phone calls and paperwork necessary. Make sure you have cash you can burn through for a few months while this is being resolved (you’ll get back pay for the time, but not until the process is completed).

    At least, that’s how it works here in Cali.

    They can’t, the Federal minimum wage is in effect…um, after 40 hours the law says you are to be paid time and a half. Federal wage law. Unless you are classified as a licensed professional (doctor, engineer, architect, lawyer) This was in the USA?

    Companies are SUCH A-holes when they do this!

    I worked at a publishing company. The owners wanted to hire some “operational manager” guy but couldn’t afford his $75K salary. They decided to give all 30 employees a 10% pay cut in order to hire this nimrod!

    After the guy starts work, his first “job” was to try and make us all work overtime on the weekends to “save” the company. He tried to bully and threaten us into doing it until I informed him that we all got pay cuts two weeks prior to his being hired so that HE could get this job. What a idiot!
    I asked him if he would be willing to take a lesser salary as well, so that we might be then be inclined to spend our weekends there.

    There are limits to how many hours that a salaried employee can work without additional compensation, but you would need to check with your particular state’s requirements. Same with unemployment. It may be possible that you would have to accept the job offered, even if it is not enough to live on. The states don’t care about that, they just want you off the books. It also may be possible that if you refuse the job that they would make you pay back all the money you previously received for unemployment, so I would do some checking before refusing the job.

    Check that with the Federal Wage and Labor board, but my memory is that if the OT is too regular a thing then they have to pay it as OT. Salary is considered based on 40 hours. Keep your own time card records of what you exactly work, meal breaks, etc.

Everything I got…my gorgeous wife, my millions in savings, the business I started – I EARNED with hard work. NO WHINING. If you’re gettin’ screwed at work – you deserve to be. And never ever again work for them. They must be held accountable, and if the law won’t do it, unlegal actions must be taken.     As a person that works in HR let me just say this. Unless you are an exempt salaried employee. This usually applies to licensed professionals or certain members of the executive staff (this should be noted in your employee handbook), they are required to pay you overtime for any time worked over 40 hours a week. No HR department would let their company not do this. The lawsuit would be very difficult to deal with. Talk to the wage and labor department. File a complaint. They will follow up with your work and see what the problem is. As for your statement about no legally being allowed to look for another job while a salaried employee, that is just not true. Legally you can look for a job at any time during your employment regardless of status. They can not keep you from finding another job. Of course, you can not use company property (i.e. work computer) to do said job search if specified under company property usage in your company policy. Please do not continue to think that just because you are salary you can not look for another job at the same time. The only exception would be the possibility of a contract employee (which salaried people aren’t) but she is still legally allowed to look. She just can’t break her contract if such an action isn’t pursuant with the terms of said contract.
